This Privacy Policy (together with the Conditions of Use and other documents referenced in the same) establishes the bases upon which INDUSTRIA DE DISEÑO TEXTIL S.A. (INDITEX S.A.) (hereinafter, INDITEX) processes information through the Inditex Group global personnel recruitment and selection platform, Inditex Careers (hereinafter, Inditex Careers or Global Platform).  It applies only to information collected through the Global Platform and not to information collected through any other web site (including web sites linked to from the Global Platform) or means. 
One of the principal objectives of the Global Platform (accessible through the URL http://www.inditexcareers.com), owned by INDITEX, is to manage the recruitment and selection processes of all companies in the Group on a global level, and to maximise opportunities for the registered users. Each time that, when using the Global Platform, you provide or it is necessary for us to access any type of information that, due to its characteristics, allows us to identify you (hereinafter, Personal Data), whether for browsing the same and making use of the services and functions, registering as a user, registering as a candidate for an offer, signing up to receive our job openings, sending a query through our contact form, etc., this will be subject to this Privacy Policy, which you agree to by providing your Personal Data. 

 

1. ORIGIN & DATA COLLECTION. 
The origin of the Personal Data that we process on the Global Platform may be any of the following:
 
- We may collect your name, address, e-mail address, phone number, and work history when you complete a form, such as an application for employment.
 
- We may collect your e-mail address and other information contained in such e-mail if you contact us by e-mail with a question.
 
- We may collect your name, e-mail address, and/or phone number if you register to receive our newsletter and other notifications from INDITEX.
 
- When you are referred by a third party, in the case that they have been authorised to reference you and to provide your contact details, we may collect such information from them. Said data may appear pre-loaded in the registration form of the Global Platform, and thus your registration as a possible candidate for participating in the recruitment and selection processes of Inditex Group may be managed. Remember that, in cases where you complete the registration process for the Global Platform, we will notify this fact to the third party that provided us with your contact details.
 
Through the Global Platform, Personal Data is gathered and processed in relation to data of an identifiable nature and personal circumstances (such as your first name, surname, address, telephone number, etc.), academic and professional data (education, etc.) and job details (profession, professional background, etc.).  The above provides examples of the Personal Data that may be collected through the Global Platform. If you do not want us to collect your Personal Data, please do not provide it to us.
By not providing certain information that is indicated as obligatory, it may not be possible to manage your registration as a user or candidate to job openings available through the Global Platform. 
2. PRINCIPAL PURPOSES OF TREATMENT. 
 
INDITEX will process your Personal Data as disclosed at the time of collection, including for the following purposes:  
 
i. Registration as a user of the Global Platform. 
The Personal Data provided to us will be added to a database operated by INDITEX, who gathers and processes this data in order to identify you as a user of the Global Platform and provide access to the different services, functions and applications that are available to you as a registered user.  
Furthermore, we may use your data to contact you via e-mail, telephone calls or SMS in relation to the update of functionalities or informative communications related to the services, including security updates of the Global Platform.
 
Legal basis: The reason why we are entitled to use your data is the execution of the terms and conditions of use of the platform
 
ii. Recruitment and selection processes of Inditex Group. 
The Personal Data provided in the registration form of the Global Platform, as well as during the use of the services and functions of said Global Platform by the registered user, will be incorporated to a database operated by INDITEX and will be subject to processing for the development, performance and management of the selection processes of Inditex Group, depending on the areas of interest that have been indicated and the offers existing to which you have sent your candidacy. 
Furthermore, we may use your Personal Data to contact you through e-mail, telephone calls or SMS for adequate management of the recruitment and selection processes in which you wish to participate.
The user (you), by accepting this Privacy Policy, guarantees that the Personal Data provided is correct and accurate and commits to notify INDITEX of any change or modification to the same. Any loss or damage caused to the Global Platform, to INDITEX or to companies pertaining to Inditex Group or any third party by the communication of erroneous, inaccurate or incomplete information in the registration forms, or other means through which information with Personal Data is provided, will be the exclusive responsibility of the user. 
Important note about the content of the additional information provided: 
It is very important that the information you provide us through the free text fields, as well as through the files, links or documents provided, does not contain any confidential or particularly sensitive information, such as: your racial or ethnic origin, your ideology or political, religious or philosophical ideology, your affiliation with political parties or syndicates, your physical or mental health, biometric data or genetic configuration, your sexual orientation, criminal background, Social Security or personal identification number, etc. 
 
If you provide this type of information, you accept your own responsibility for the possible risks to your privacy. If we detect this type of information, we will proceed to delete it from our systems and under no circumstances will it be taken into consideration for the selection processes.

3. DISCLOSURE OF PERSONAL DATA.
 
Personal Data provided in connection with the registration forms will only be used for the purpose of determining a candidate’s eligibility.  With consent, this Personal Data may be shared in the following instances:
 
  • To affiliated entities and other companies that form part of the Inditex Group.  For example, if you submit an application, we may share your Personal Data with our affiliated entities to review and process your form and to ensure that your form is directed to the proper entity.
 
  • To unaffiliated third-party service providers, agents or independent contractors who help us maintain our Global Platform and provide other administrative services to us (including, but not limited to maintaining and analyzing data, and sending communications on our behalf). We seek to ensure that these unaffiliated third parties will not use the Personal Data for any other purpose than to provide the administrative services for which they are responsible. Because such unaffiliated third-party service providers that help us administer our Global Platform will have access to Personal Data provided through the Global Platform, if you do not wish for our unaffiliated third-party service providers to have access to your information, please do not register or submit any Personal Data to us.
 
  • To comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, including the rights and property of INDITEX and our Global Platform or act in urgent circumstances to protect the personal safety of our end users.
 
  • To third parties as part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.
 
  • To protect against potential fraud, we may verify with third parties the information collected through the Global Platform. In the course of such verification, we may receive Personal Data about you from such services. In particular, if we must conduct a background screening, we may use third party screening services to confirm information provided and to conduct such screening. 
Except as described in this Privacy Policy or at the time we request the information, we do not otherwise use, share or otherwise disclose your Personal Data to any third parties.

 

4. VISIBILITY, COMMUNICATION AND INTERNATIONAL TRANSFER OF YOUR DATA.
 
Given that one of the principal objectives of the Global Platform is to manage, on a global scale, the selection processes for all of the Inditex Group companies and to maximise the opportunities for the registered users, once you are registered your Personal Data will be visible to all personnel of INDITEX and other companies that form part of Inditex Group depending on your profile and selected preferences, as permitted by the applicable regulations, with the purpose of facilitating the search for candidates that adapt to the different selection processes that may be in progress within Inditex Group, and to increase the possibilities of the users to be considered as candidates.  
Therefore, in order to comply with the objectives indicated in the previous paragraph, it may be necessary for us to communicate or transfer the information you provided to certain companies that form part of Inditex Group (whose activities are related to the sectors of decoration, textiles, finished products for wearing and for the home, and any others that complement the former, including cosmetics and leather, as well as the development and support of e-commerce, construction, logistics, transport and distribution), to the extent that they need to access your Personal Data, because they are directly involved in the selection processes to which you have sent your candidacy or because the interests indicated by the user may fit the candidate profile that they are seeking, therefore we understand that when you register and provide us information through the Global Platform, you are expressly authorising us to make these communications and/or transfers to the mentioned companies.
By sending your application to a vacancy advertised on the Global Platform or providing your contact information in order to show your interest in a job opening, you expressly accept that your information may be revealed to the Inditex Group company in the target country indicated in the offer, even in cases where access to your Personal Data constitutes an international transfer of the data and the access will be produced from countries that do not provide a level of data protection that is comparable to that provided in your own country or, where applicable, to that of the European Union. Access to the users’ data by personnel of the Inditex Group companies will be subject to the regulations applicable in each case, including the necessary measures of technical and organisational security in order to guarantee the confidentiality of the candidates data. 
The Personal Data communicated or that which is accessed by the Inditex Group companies will be included in the respective databases, therefore these Inditex Group companies may locally use and store your Personal Data with the purpose of managing the selection processes. 

 

5. CONSERVATION, STORAGE OF THE INFORMATION AND USER RIGHTS. 
 
You can keep your Personal Data and the content of your profile and registered user account up to date on the Global Platform through the "My account" section. 
We will keep your Personal Data as long as your account remains active. In this sense, we inform you that your registered user account will expire after 18 months if no sessions are initiated. Before proceeding to delete your account, you will receive a reminder e-mail informing you of how to proceed in order to avoid the expiration of your account and the consequent cancellation of your data. 
You can revoke the acceptance of this Privacy Policy, as well as the authorisation for international transfer or communication of data that may lead to the management of your candidacies through the Global Platform in the "My account" section.  If you revoke your consent, your registered user account on the Global Platform will be cancelled. 
Please take into consideration that once you have presented your candidacy for a vacancy and your information has been provided to the Inditex Group company that offered this vacancy, INDITEX cannot recover your curriculum vitae from those that have had access to it and can only delete online access to the same and, in the case of an express request from you, we will proceed to cancel your data as a candidate in the applicable Inditex Group information systems. 
INDITEX, with corporate address at Avenida de la Diputación, Edificio Inditex, 15142 Arteixo (A Coruña), Spain, as the data controller, commits to respect the confidentiality of the personal data and to guarantee the exercise of the rights of access, rectification, erasure and objection, the same through a letter addressed to the above address, indicating the attention of "Función LOPD – Inditex Careers" or by sending an e-mail to dataprotection@inditexcareers.com
In the case that you wish to exercise said rights, please inform us of the e-mail address used to identify yourself or to use the services or functions of the Global Platform, and for which you wish to exercise the rights to access, rectify, erase and object. If necessary, we may request a valid form of identification.

 

If you are in the European Economic Area:
We undertake to keep your personal data confidential and to ensure that you may exercise your rights. Bearing that in mind, you may exercise your rights free of charge by writing us an e-mail to our e-mail address dataprotection@inditexcareers.com, simply informing us of the reason for your request and the right that you wish to exercise. If we consider this necessary to be able to identify you, we may request you to provide a copy of a document evidencing your identity. 
In particular, notwithstanding the purpose or legal basis we use to process your data, you have the following rights:

  • To request access to your personal data that we hold. We remind you that where you are a Platform registered user you may also consult this information in the relevant section of your online account. 
  • To request that we rectify the personal data that we hold. Please bear in mind that if you are a registered user on the Platform, you may also access the relevant personal data section of your online account to change or update your personal data. In any case, please take into account that, on actively making your personal data available to us through any procedure, you guarantee that they are true and accurate and you undertake to notify to us any change or modification of your data. You will be liable for any loss or damage caused to the Platform or to the person responsible for the Platform or to any third party by reporting erroneous, inaccurate or incomplete information in the registration forms. Please remember that, as a general rule, you must provide us only with your own data, not with those of third parties, other than to the extent otherwise permitted in this Privacy Policy.  
  • To request that we erase your personal data to the extent that they are no longer necessary for the purpose for which we need to keep processing them, as we have explained above, or when we are no longer legally permitted to process them. 
  • To request that we cancel or limit the processing of your personal data, which entails that in certain cases you can request us to temporally suspend the processing of the data or that we keep them longer that necessary. 

If you have given us your consent to process your data for any purpose, you also have the right to withdraw such consent at any time. Some of the circumstances in which you may withdraw your consent are detailed in section 2 where we explain for which purposes we process your data. 
When we are legally permitted to process your data due to your consent or to for the purposes of a contract, as explained in section 1, you will also have the right to request the portability of your personal data. This means that you will have the right to receive the personal data that you made available to us in a structured, commonly used and machine-legible format, to be able to transmit them to another entity directly without impediments on our part.
In addition, where the processing of your data is based on our legitimate interest, you will also have the right to object to the processing of your data.

6. INFORMATION ABOUT COOKIES. 
 
On the Global Platform we may collect your IP address, web beacons, and use cookies, small text files with information about your browsing on this site, the principal objective of which is to improve your experience on the Global Platform. 7. SECURITY.
 
No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to INDITEX is done at your own risk. 
 
Once we receive your transmission, we make reasonable efforts to ensure security on our systems. We use firewalls to protect your information from unauthorized access, disclosure, alteration, or destruction. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software.
 
If we learn of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using these Global Platform or providing Personal Data to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Global Platform. We may post a notice on our Global Platform if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

 

8. MODIFICATIONS. 
 
Consult the Privacy Policy regularly as it may be subject to modification. You can consult the valid version at any time through the Global Platform and note the effective date listed at the bottom of this policy. Remember that it is your responsibility to read it periodically, as the Privacy Policy valid at the time of use of the Global Platform is the version which will be applicable. 

 

9. COMPLIMENTARY SERVICES OR FUNCTIONS. 
 
In addition to the regular functions of the Global Platform, the Global Platform also offers a series of specific functions or services that may be voluntarily activated by accepting the specific conditions. 
 
i. SEND TO A FRIEND 
The Global Platform has a "send to a friend" function, that may be voluntarily used in the case that you wish to send information to a third party via e-mail about a specific opportunity or job opening or about a news story. For this, you must fill in the form available for this purpose and provide your friends name and e-mail address, checking the box for acceptance of the corresponding conditions. 
Your friend´s data will be deleted once the e-mail is sent with the information related to said job opening or after a reasonable period of time. 
Remember that if you provide the Personal Data of third parties, you will be responsible for having notified them and for having obtained their consent to provide this data for the purposes indicated prior to sending the information, and after sending it. In the case that you proceed with sending through the Global Platform, the third party Personal Data provided will only be used for: 
  • management of sending or verification of receipt of the communication, and
  • responding to requests sent to us by said third party.

Legal basis: Our legitimation to use your data is the consent you give us

 
ii. COMMUNICATION BY E-MAIL, SMS OR TELEPHONE 
In the case that you are interested, you may voluntarily select the possibility of receiving notifications with information about the job openings that are published on the Global Platform. 
For this, you must check the box available in the Newsletter section, providing your express consent to sign up to our notifications service and authorising INDITEX to send you information about the job opportunities with the parent company and also with the other entities that form part of Inditex Group, where the recruitment and selection processes will be managed through the Global Platform and in accordance with the preferences indicated. 
These notifications will be made depending on the preferences indicated through the Global Platform, including the sending of communication via e-mail or via any other equivalent electronic means of communication (such as SMS) as well as through telephone calls. You may change your preferences in relation to the notification of these communications by accessing the "My account" section, or reject the use of your data for sending notifications at any time through the "My account" section, selecting the corresponding deactivation box. 
Take into account that in order to send these notifications, it may be necessary for third party technological service providers to access your Personal Data where essential for this function. Your authorisation includes cases where, for service efficiency, the providers may be located in the United States of America or other countries or territories located outside the European Economic Area which do not provide the same level of data protection as in your own country or, where applicable, as in the European Union. 
 
iii. QUERY MANAGEMENT 
In the case that you wish to ask us any question, through e-mail or the contact form, your Personal Data and contact details may be used by INDITEX in order to respond to your queries, including those related to the technical service of the Global Platform, operation of the same, doubts/suggestions related to the selection processes, etc. 
For adequate management of your queries, it may be necessary for us to contact you through e-mail, telephone calls or SMS.

CONDITIONS OF USE OF THE "INDITEX CAREERS" WEBSITE BY INDITEX

1. INTRODUCTION 
 
These terms and conditions (the "Inditex Careers Conditions"), together with the Privacy Policy  and the Cookies Policy  (jointly hereinafter, the "Data Protection Policies"), regulate the access and use of the employment website "Inditex Careers" and each and all of the web pages found under the domain "inditexcareers.com", as well as the respective sub-domains and sub-directories (hereinafter, the "Website" or "Inditex Careers"). 
 
The Website is operated by INDUSTRIA DE DISEÑO TEXTIL, S.A. The purpose of the Website is to provide the user (hereinafter, “you” or the “user”) with access to job openings in the various companies of INDITEX Group and to permit the companies of INDITEX Group access to the curriculum vitae of the registered users in the terms and with the requirements indicated on the Website. 
 
Access to the Website and the use of its content and services implies full and unreserved adhesion to the Inditex Careers Conditions that are valid and published on the Website at the time the user accesses it and as of the effective date noted at the bottom of this policy. If you do not agree to these Inditex Careers Conditions, please do not use the Website.
 
The most recent version of these Inditex Careers Conditions may be consulted at any time on the Website. If the user decides not to accept the valid Inditex Careers Conditions, they must refrain from accessing the Website and/or using the content and/or services available therein.
 
INDITEX reserves the right to modify the present Inditex Careers Conditions at any time and without prior notice. 
 
2. PURPOSE OF THE INDITEX CAREERS CONDITIONS
 
2.1 The purpose of these Inditex Careers Conditions is to regulate access and use of the Website, as well as the relationship between the users and INDITEX derived from the use of the Website.

The user acknowledges and accepts that INDITEX may interrupt, deactivate and/or cancel any of the Content and/or Services that form part of the Website at any time.
 
2.3 Each time that this Website is used, it will be subject to the application of the Privacy Policy that is valid at that moment, therefore, the user must review such policy to ensure that they are in compliance and agreement with the same.
 
3. SPECIFIC CONDITIONS
 
3.1 The access and use of certain Content and/or Services may be subject to certain specific conditions, legal notices, guidelines and regulations for use that, with prior notification of the user, and depending on each case, will replace, complete and/or modify the Inditex Careers Conditions stated herein (hereinafter, the "Specific Conditions"). The access and use of said Content and/Services will imply, therefore, full adhesion to the Specific Conditions that regulate the same in the version that is valid and published at the time the user accesses them, with these Specific Conditions becoming automatically incorporated to these Inditex Careers Conditions.
 
3.2 In the case of any contradiction between the terms and conditions stated in the Inditex Careers Conditions and the Specific Conditions, in all cases the terms agreed in the Specific Conditions will always prevail with regards to the incompatible terms and only with regards to the Contents and/or Services that are subject to this specific regulation.
 
3.3 Use of this Website is for individuals above the age of majority in their jurisdiction of residence.
 
4. ACCESS TO THE CONTENT AND SERVICES
 
4.1 For access to the Website, the user must: (i) have an Internet connection; (ii) pay the corresponding access and connection fees and (iii) have the equipment and information systems necessary in order to complete the Internet connection.
 
4.2 For correct access, viewing and implementation of certain Content and Services of the Website, it may be necessary to download and install certain computer programs or other logic elements. The user will be liable for this installation, with INDITEX declining any type of liability that may be derived from the same.
 
4.3 The user is obliged not to access the Content and/or Services of the Website through any means other than the screen interface that INDITEX provides for access to the same. 
 
5. SERVICE ACTIVATION 
 
5.1 INDITEX may require the activation of the user through a registration form and, where applicable, the acceptance of certain conditions in order to grant access to certain Content and/or Services. In this case, the user must provide the information requested and follow the established activation process in order to access the Content and/or Services in question. 
 
In relation to the activation process, the user is obliged to: (i) provide accurate, precise and complete data and (ii) update the activation data so that it is at all times accurate, precise and complete. The user may not choose a username or password consisting of words and/or expressions that, in general, are contrary to the law or to normal moral demands and generally accepted good conduct as determined by INDITEX in its sole discretion and, in general, words and/or expressions where any rights are held that exclude use of the same by the user.
 
If the user provides any false, inaccurate or incomplete data, or if INDITEX has sufficient motive to suspect that said information is false, inaccurate or incomplete, or contrary to law or to normal moral demands and generally accepted good conduct, INDITEX will have the right to cancel the activation and to deny access and use, present or future, of the Website or or any of the Contents and/or Services incorporated therein. 
 
5.2 Inditex Careers user profile is personal and non-transferable. 
 
Identification on Inditex Careers is the user´s e-mail address and password(s). For this reason, we recommend to use a personal e-mail address and maintain the confidentiality of your passwords at all times. 
 
If you the user became aware of any unauthorised use of Inditex Careers through your profile, you must notify us immediately through the e-mail address soporte@inditexcareers.com.
 
5.3 The user undertakes to make diligent use of their username and password, and to maintain the confidentiality of both. It will be the exclusive liability of the user to maintain the confidentiality of their username and password, and they personally assume the risk of any activities carried out or that take place through the use of the same.
 
5.4 The user may deactivate their profile at any time by using their username and password. The user acknowledges and accepts that INDITEX reserves the right to deactivate any profiles that are inactive for a period of 18 months or that do not comply with these Inditex Careers Conditions which regulate use of the Website. 
 
6. REGULATIONS FOR USE OF THE WEBSITE
 
6.1 The user undertakes to use the Website and the Content and/or Services incorporated therein in a diligent and correct manner. Furthermore, the user undertakes not to use the Website: (a) for the performance of any activities that are contrary to the law, to morals, to good conduct or established public order as determined by INDITEX in its sole discretion, (b) for any purposes or effects that are illicit, prohibited or adverse to the rights and interests of third parties, and (c) for any solicitation of anyone to buy or sell products or services or to make donations of any kind, absent express written approval, with INDITEX declining any liability that may be derived from all of the above. 
 
6.2 The user acknowledges and accepts that they will use the Website and the Content and/or Services exclusively for the purposes for which it was created. It is expressly prohibited for the user to authorise a third party to use the Website, either totally or partially, or to introduce and/or incorporate the Contents and/or Services to a business activity as their own.
 
The use and or application of any technical, logical or technological resources is expressly prohibited where the user may benefit, directly or indirectly, from the unauthorised use of the Content and/or Services of the Website.
 
6.3 The user undertakes not to damage, render useless, overload or deteriorate the equipment and information systems or telecommunication systems of INDITEX or of any third party, or any of the content incorporated and/or stored on the same.
 
6.4 The user will abstain from using the Content and Services in any manner that may damage, render useless, overload or deteriorate the Website or impede normal use or enjoyment of the same by other users.
